Terms

Terms of business.

Short and plain: a fixed price before anything starts, a deposit, and the drawings are yours once paid.

1. Who we are

JPA Design is the trading name of Jamie Phillis, a sole trader. Email jamie@jpa-design.co.uk, phone 07399 358543. These terms apply to every quote and job unless the quote says otherwise in writing.

2. What we do

We produce drawings, 3D models, schedules and files (the work) from the information you send us: the architect's and engineer's drawings, surveys, photos and specifications. We draw to your engineer's design. We do not design or check the structure, and the checks we report (clashes, gaps, guarding heights and the like) are drafting checks, not a design certificate. The work is only as accurate as the survey and information supplied; where something does not add up, we raise it as a query.

3. Quotes

Every job gets a fixed price and a programme in writing before work starts. A quote is valid for 30 days and covers the scope it lists. Changes to the scope or the design after we start, and information that arrives late, are priced and agreed before we do them.

4. Deposit and payment

A deposit of 30% to 50% of the quoted price, depending on the size and length of the job, is paid before work starts; the quote states the amount. Larger jobs may be invoiced in stages, for example on issue of the approval set and of the fabrication pack, as the quote sets out. The balance of each invoice is due within 14 days, or within 30 days where the quote says so. We are not VAT registered, so no VAT is added.

5. Late payment

If an invoice is paid late we may charge statutory interest at 8% above the Bank of England base rate, and the fixed compensation of £40, £70 or £100 depending on the amount owed, under the Late Payment of Commercial Debts (Interest) Act 1998. We may also pause work on your jobs until the account is up to date.

6. Programme

Dates run from receipt of the deposit and the information we need. If information is missing or late, or comments come back late, the dates move by the same time. We tell you straight away if a date is at risk.

7. Comments and approval

Two rounds of comments are included in the price. Further rounds, and changes after approval, are priced first. You check the drawings against your design and the site before approving them, and fabricate or install only from drawings issued for construction, at their latest revision.

8. Ownership and use

Once the job is paid in full, the drawings and files we deliver are yours to use for that project. Until then they remain ours and must not be used for fabrication or installation. We keep our own methods, templates and tools, and copies of the work for our records. We do not show your project publicly without your permission.

9. Confidentiality

What you send us is kept confidential and used only for your job. We sign a non-disclosure agreement on request.

10. Our liability

We take care over every sheet, and we correct our own errors free of charge. Our total liability for a job is limited to the fee paid for that job. We are not liable for indirect losses such as loss of profit, delay or site costs, or for work built from drawings that were not approved or not at their latest revision. Nothing in these terms limits any liability that the law does not allow to be limited.

11. Cancelling

You can cancel a job at any time by email. You pay for the work done up to then; the deposit is kept against it, and anything left over is refunded.

12. Law

These terms are governed by the law of England and Wales.
